The Civil Aviation Authority of Malaysia (CAAM) has issued Advisory Information 02/2026 to inform the public regarding a public consultation to be conducted by CAAM on the application summary in relation to the joint venture agreement between Singapore Airlines Limited and All Nippon Airways Co., Ltd.
The applicants have submitted an application for an individual exemption in respect of the JVA in accordance with section 36Q of the Civil Aviation Authority of Malaysia Act 1969 [Act 788].
Joint venture agreement
The applicants entered into the JVA on 17 April 2025 in respect of scheduled air passenger services between Japan, Singapore, Australia, India, Indonesia, and Malaysia. These are referred to as the JVA Markets.
The JVA is subject to and conditional upon the applicants obtaining all applicable approvals from the relevant authorities, including CAAM. The JVA also falls within the scope of section 36O of Act 788.
In the implementation of the JVA, flights operated by subsidiaries of Singapore Airlines or All Nippon Airways shall not be included, except for specific flights operated by Air Japan Co., Ltd., ANA Wings Co., Ltd., and Nippon Cargo Operators Co., Ltd., where NQ and EH are the flight operators entrusted by NH to operate on behalf of NH.
Activities under the JVA
Under the JVA, the applicants will coordinate certain commercial activities, including fares, sales, marketing, network planning, scheduling, capacity, and inventory management strategies for routes within the JVA Markets.
The JVA also provides for revenue sharing and joint performance measurement in relation to passenger revenue on specified routes operated by the applicants.
The applicants submit that the JVA is intended to generate operational efficiencies and enhance connectivity, thereby providing benefits to passengers such as improved travel options and more competitive fares. The applicants further submit that the JVA is unlikely to give rise to significant adverse effects on competition, given the limited overlap between their services in relation to Malaysia.
Public consultation
CAAM will undertake a public consultation in relation to the application summary on the JVA between SQ and NH.
The purpose of this public consultation is to invite views, comments, and submissions from interested parties, including industry stakeholders and members of the public, on the potential impact of the JVA on competition and the aviation sector.
Details of the consultation, including the relevant documents, submission procedures, and deadline for responses, will be made available on CAAM’s official website by the end of this week.
CAAM invites all interested parties to submit their written submissions within the stipulated consultation period. All submissions received will be duly considered as part of CAAM’s assessment.
