Civil Aviation Regulations 2016 (MCAR)

2. MCAR 2016 & Drone Laws (Regulation 140-144)

For drone pilots, Part XVI is the most critical section of the MCAR 2016. It establishes that:

  • Regulation 140: No person shall fly a drone in a manner that endangers persons or property.
  • Regulation 141: Restrictions on flying drones in “Controlled Airspace” or near aerodromes without CAAM authorization.
  • Regulation 143: Specific rules for surveillance drones (aerial photography) and the requirement for JUPEM security clearance.

3. 2026 Regulatory Updates & Amendments

The MCAR is not static. As of March 2026, several key amendments have been integrated to align with EASA and ICAO standards:

  • Digital Licensing: Transition from paper-based pilot licenses to secure digital credentials under Part V.
  • U-Space Integration: New provisions for managing high-density drone traffic in urban “Low-Altitude Corridors.”
  • Fees & Charges: Updated fee structures for the issuance and renewal of certificates under the Civil Aviation (Fees and Charges) Regulations.

4. Penalties for Non-Compliance

Violating the MCAR 2016 can lead to severe legal consequences under Section 24O of Act 3:

  • Individuals: Fines of up to RM 50,000 or imprisonment for up to 3 years.
  • Corporate Entities: Fines of up to RM 100,000.
  • Enforcement: CAAM inspectors and the Royal Malaysia Police (PDRM) have the authority to ground aircraft found in breach of these regulations.
